Immigration Detention And Bail

 In most cases the immigration authorities have a duty by law to grant bail unless they can prove that there is a good reason for detaining someone. Some of the main reasons someone may be detained may include but not limited to the following:

  • The authorities need to establish your identity. This may happen if your identity documents are not available
  • You have failed to give satisfactory or reliable answers to an Immigration Officer’s enquiries.
  • It is likely that you will not comply with the authorities while your application is being decided, or you have failed to comply in the past
  • You do not have any close ties (such as relatives or friends in the UK) with whom you could stay with
  • You have previously failed to comply with conditions of your stay, bail or release.
  • You have previously absconded or escaped.
  • You have used or attempted to use deception in a way that leads the Home Office to consider that you may continue to deceive them
  • You are waiting to be removed from the UK or the outcome of a DAC application

Our solicitors at Orwillo and co will be able to represent detainees’ interests to the immigration tribunal and have them released on bail provided the meet certain criteria. At Orwillo solicitors, we can advise and assist those who are detained in the Immigration Removal Centres (IRC) or other detention facilities across the UK.

What we do in Bail applications

  • We assess your eligibility for bail and determine whether a Chief Immigration officers bail is appropriate or an Immigration Judges bail to the AICFTT
  • Review any previous applications with the Home Office/court for bail and evaluate their potential impact on any current bail application.
  • Provide guidance on the list of documents required to support a successful bail application
  • Advise on the chances of success for a bail application, highlighting its merits and potential weaknesses.
  • Draft the grounds for bail
  • Complete the relevant bail application form
  • Arrange for the sureties to be available and provide supporting documents
  • Advice on any change of circumstances since last bail if any
  • Prepare a client care letter advising you on the bail and relevant law and chances of success
  • Draft covering letter forwarding all the supporting documents.
  • Lodge the application with the CIO or ATFTT.
  • Represent you at any bail hearing and or make representations to the CIO
  • Handle all correspondence with the Home Office on your behalf before the outcome is reached.
  • Provide advice on the next steps following the outcome of your bail application

  2. CIO Bail - Solicitors’ fees are £600 -£800 Fixed Fee - Plus VAT. VAT Registration Number 483718753.

What may not be included in the quote

  1. translation fees applicable to your bail application
  2. interpreter fees applicable to your bail application
  3. expert report applicable to your bail application
  4. If your application is refused the quote above does not include any advice for an appeal

Mr M. Sourbah is a qualified duty solicitor and an Immigration lawyer, admitted as a solicitor of the supreme courts of England and Wales in February 2008. He is director of Orwillo solicitors. He specialises in Crime and Immigration laws and practice and was accredited on the Law society scheme Immigration and Asylum

accreditation scheme and is currently an accredited criminal duty solicitor. He would be carrying out most of the work.

From time to time, he may be assisted by colleagues or other members of staff. Where he is unavailable due to unforeseen circumstances or capacity, the services of outside agencies like barristers’ chambers experts, or colleagues in another solicitor’s firm may be offered. Where this is the case and they charge VAT for their work, that may be claimed on an invoice and the defendant is expected to pay.

VAT Statement

Value Added Tax (VAT) is added onto prices in the UK for provision of services. Currently the percentage or the financial amount of VAT payable is 20% of the total cost of a transaction. The Firm is registered for VAT under registration number 483718753 and may charge 20% on top of the fee charged for the provision of our services.

Some of the fees or disbursements of the agents we work with may also attract VAT. For example, experts, barristers and interpreters’ fees may include 20% VAT in their invoices which is passed on to the client to pay.

Disbursements

Disbursements are charges payable in addition to our fees, normally to a third party. They can include fees payable to the Court, Barristers and other experts such as medical experts who may be required to provide evidence in your case, Home Office Administrative fees, Immigration Health Surcharge (IHS), interpreters’ fees, etcetera. The amount charged for the disbursements depends upon different variables as well as the expert attendance at Court if applicable.

Barrister’s fees are from £500.00 plus VAT depending on the type and complexity of the hearing. Experts’ costs can be from £1,200.00 plus VAT depending on the type and complexity of the case. Home Office Administrative fee depends on the category of the application and IHS may be calculated on the number of years leave applied for and granted. Interpreters’ fees may also be charged at hourly rate.

All additional costs / disbursements where applicable will be discussed with you in advance of instruction.

The Agreed fixed fee is for the entirety of our work leading to a decision.
